Virtual Try-On and Image Privacy
This Virtual Try-On and Image Privacy Policy explains how WardrobeIt processes photographs, generated previews, product selections, and related information when a shopper uses a WardrobeIt Virtual Try-On experience.
This policy supplements the WardrobeIt Privacy Policy and Terms of Service. If you access Virtual Try-On through an ecommerce store, the store’s privacy policy also applies.
In this policy, “WardrobeIt,” “we,” “us,” and “our” refer to WardrobeIt and the applicable WardrobeIt contracting entity.
“Merchant” refers to the ecommerce store or business that enables WardrobeIt on its storefront.
“Shopper,” “you,” and “your” refer to the individual using Virtual Try-On.
By selecting the consent option and submitting an image, you acknowledge that WardrobeIt will process the image as described in this policy.
Do not upload an image if you do not agree with this policy.
Plain-Language Summary
WardrobeIt Virtual Try-On allows an adult shopper to submit a photograph and generate an artificial visual preview of an eligible product.
WardrobeIt processes the image only to provide, secure, support, and improve the requested Virtual Try-On experience.
WardrobeIt does not use Virtual Try-On images to:
- Identify or authenticate shoppers
- Create facial-recognition profiles
- Build biometric identity databases
- Infer health conditions
- Analyse emotions
- Determine race, ethnicity, religion, political views, sexual orientation, or other sensitive traits
- Make decisions about credit, employment, insurance, housing, education, healthcare, or legal rights
- Recommend products from competing stores
- Target unrelated advertising
- Sell shopper images
- Train general-purpose AI models without separate, explicit permission
Virtual Try-On is intended for adults. Do not submit an image of a child or anyone under eighteen.
How Virtual Try-On Works
When Virtual Try-On is available for an eligible product, you may be invited to:
- Select a supported product
- Select an available colour or variant
- Upload or capture an appropriate image
- Review the image-processing notice
- Provide consent
- Generate a visual preview
- Return to the product
- Compare supported options
- Continue to the merchant’s product page or cart
WardrobeIt uses automated image-processing technology to create a digitally generated or altered representation of the selected product with the submitted image.
The generated result is an artificial preview. It is not a photograph of the actual product being worn, and it should not be treated as proof of exact product appearance, size, fit, colour, shape, proportions, texture, material behaviour, or real-world outcome.
Information Processed During Virtual Try-On
Depending on the merchant’s implementation and the feature being used, WardrobeIt may process the following information.
Submitted Image
The photograph you upload or capture for the Virtual Try-On experience.
The image may contain visible physical characteristics, clothing, surroundings, or other information appearing in the photograph.
You should submit only an appropriate image of yourself that you are authorized to use.
Generated Preview
The artificial image created through the Virtual Try-On process.
The preview may combine or visually align the submitted image with the selected merchant product.
Product and Variant Information
WardrobeIt may process information about the selected product, including:
- Product identifier
- Product name
- Product image
- Product category
- Selected colour
- Selected size
- Selected variant
- Product URL
- Merchant store
- Applicable synchronized availability
Session and Technical Information
WardrobeIt may process technical information needed to operate and protect the feature, including:
- Session identifier
- Date and time
- Device type
- Browser type
- Operating system
- Approximate network information
- Error information
- Feature status
- Processing events
- Security and abuse-prevention signals
Interaction Information
WardrobeIt may record supported events such as:
- Virtual Try-On opened
- Consent displayed
- Consent provided
- Image submitted
- Preview requested
- Preview completed
- Preview failed
- Product changed
- Colour changed
- Product page opened
- Add-to-Cart action attempted
- Add-to-Cart action confirmed
These events help operate the feature, troubleshoot problems, understand feature usage, and provide supported merchant analytics.
Consent and Privacy Records
WardrobeIt may retain records showing:
- Which privacy notice was displayed
- When consent was provided
- The merchant and store involved
- The feature requested
- Whether consent was withdrawn
- Whether deletion was requested
- When a deletion request was completed
Consent records may be retained longer than the image itself when necessary to demonstrate compliance, resolve disputes, or meet legal obligations.
How WardrobeIt Uses Image Information
WardrobeIt may use submitted images and generated previews only for legitimate purposes connected with the Virtual Try-On service.
These purposes may include:
Generating the Requested Preview
Processing the submitted image with the selected eligible product to create the shopper-requested preview.
Displaying the Preview
Returning the result to the shopper within the WardrobeIt or merchant storefront experience.
Supporting Product Evaluation
Allowing the shopper to compare eligible products, colours, or supported product options.
Maintaining Feature Functionality
Operating the image-processing workflow, session, product selection, user interface, and generated output.
Preventing Fraud and Misuse
Detecting prohibited content, harmful activity, unauthorized access, automated abuse, excessive requests, or attempts to compromise the service.
Diagnosing Technical Problems
Investigating failed generation, incorrect product mapping, display errors, performance problems, or other technical issues.
Measuring Feature Usage
Recording limited product and interaction events for merchant reporting and service operation.
Usage measurement should not require WardrobeIt to reveal the submitted image to the merchant unless that capability has been expressly implemented, disclosed, and authorized.
Meeting Legal Obligations
Retaining or disclosing information where reasonably necessary to comply with applicable law, respond to valid legal requests, protect rights, or investigate security incidents.
Consent Before Image Processing
WardrobeIt should not begin processing a shopper image until the required privacy notice has been shown and the shopper has taken a clear consent action.
The consent request should explain:
- That an image will be processed using AI
- That an artificial preview will be created
- Why the image is needed
- Whether the image or preview will be retained
- How deletion can be requested
- That Virtual Try-On is not a fit guarantee
- That the feature is intended for adults
- Where this policy can be reviewed
Consent should not be hidden inside unrelated website terms or automatically assumed from ordinary storefront browsing.
Where applicable, you may withdraw consent or request deletion by contacting the merchant through which you used Virtual Try-On or by contacting WardrobeIt at hi@wardrobeit.com.
Withdrawal does not affect processing that lawfully occurred before the withdrawal request was received.
Image Ownership and Permission
You retain any rights you have in the image you submit.
By submitting an image, you confirm that:
- The image shows you
- You created the image or have permission to use it
- You have authority to allow WardrobeIt to process it
- The image does not violate another person’s privacy
- The image does not infringe copyright or other rights
- The image does not contain prohibited or unlawful content
- The image does not show a child or person under eighteen
You grant WardrobeIt a limited right to process the image only as required to provide and protect the requested Virtual Try-On experience and for the other limited purposes described in this policy.
You do not grant WardrobeIt ownership of your image.
Images of Other People
Do not upload an image containing another identifiable person unless that person is an adult, has been informed about the processing, and has given appropriate permission.
You must not secretly capture, upload, or process another person’s image.
WardrobeIt may remove content or restrict access where it reasonably believes an image was submitted without appropriate authority.
Children and Minors
WardrobeIt Virtual Try-On is intended for adults who are at least eighteen years old.
Do not upload:
- An image of a child
- An image of anyone under eighteen
- A family photograph containing a child
- A school photograph
- An image submitted on behalf of a minor
- Children’s images for product modelling or analysis
WardrobeIt does not currently offer general Virtual Try-On for children’s or baby-fashion journeys.
If WardrobeIt becomes aware that an image of a minor has been submitted, it may delete the image, disable the applicable session, suspend access, and take other appropriate steps.
Merchants must not enable or promote WardrobeIt Virtual Try-On for children without WardrobeIt’s prior written approval and a separate legally reviewed privacy, consent, and safety framework.
Biometric and Sensitive Information
A photograph may be treated as personal information and, depending on the applicable law and the technical processing involved, may also be treated as sensitive or biometric information.
WardrobeIt Virtual Try-On is not designed to identify or authenticate a person.
WardrobeIt does not intentionally use submitted images to:
- Create faceprints
- Create scans of face geometry for identification
- Create voiceprints
- Create fingerprint or iris templates
- Compare a shopper against an identity database
- Confirm a person’s identity
- Track the same person across unrelated stores
- Identify individuals in public or private images
- Perform biometric surveillance
- Categorize people by sensitive characteristics
WardrobeIt does not use Virtual Try-On as facial-recognition technology.
If an implementation would involve regulated biometric information beyond the processing described in this policy, WardrobeIt and the Merchant must provide any legally required additional notice, consent, retention schedule, and deletion procedure before enabling that implementation.
No Sensitive-Trait Inference
WardrobeIt does not use Virtual Try-On images to infer or predict:
- Race or ethnicity
- Religious beliefs
- Political views
- Trade-union membership
- Sexual orientation
- Gender identity
- Medical condition
- Disability
- Pregnancy
- Emotional state
- Financial condition
- Immigration status
- Criminal history
- Other legally protected or sensitive characteristics
Visible characteristics in an image should not be used to build a sensitive profile of the shopper.
No Identity Recognition or Cross-Store Tracking
WardrobeIt does not use a shopper image to recognize the shopper during a later visit.
WardrobeIt does not use facial information to link the same person across:
- Different merchants
- Different WardrobeIt sessions
- Advertising networks
- Social platforms
- Public records
- Unrelated databases
Standard session or account information may still be used where necessary to maintain an active shopper session, provide a requested account feature, prevent abuse, or comply with the general Privacy Policy.
No General-Purpose AI Training Without Separate Permission
WardrobeIt does not use shopper Virtual Try-On images or generated previews to train general-purpose AI models unless:
- The shopper receives a separate and clear explanation
- The shopper gives separate, explicit permission
- The Merchant permits the proposed use
- Applicable legal requirements are satisfied
Consent to generate a Virtual Try-On preview is not consent to train a general-purpose AI model.
WardrobeIt requires image-processing service providers to process images only for the authorized service purpose and not for their own advertising or independent model-training purposes, subject to the applicable provider agreement.
The technical and legal teams must confirm that all production vendors support these restrictions before the feature is launched.
No Sale or Advertising Use
WardrobeIt does not sell shopper photographs or generated Virtual Try-On previews.
WardrobeIt does not use Virtual Try-On images for cross-context behavioural advertising.
WardrobeIt does not provide images to data brokers, advertising networks, or unrelated merchants.
Virtual Try-On activity may be used to understand feature adoption or product engagement, but image content should not be used to create unrelated advertising profiles.
Image Retention
WardrobeIt retains submitted images and generated previews only for the period reasonably necessary to provide the requested Virtual Try-On experience, maintain any shopper-requested session feature, resolve technical issues, protect the service, or comply with legal obligations.
WardrobeIt does not retain Virtual Try-On images indefinitely.
Submitted Images
Where Virtual Try-On is configured for temporary processing, the original submitted image is used to create the requested preview and is then placed into the applicable deletion process after the required processing or session purpose is complete.
Generated Previews
Generated previews may remain available for the active session or for another period clearly disclosed to the shopper where an approved save or history feature is offered.
Where no save or history feature is enabled, generated previews should be treated as temporary session content.
Security and Troubleshooting Retention
An image or preview may be retained for a limited additional period where necessary to:
- Investigate a reported technical problem
- Investigate abuse or fraud
- Respond to a security incident
- Protect a shopper, merchant, or WardrobeIt
- Comply with a lawful preservation request
Access during such retention should be restricted to authorized personnel with a legitimate need.
Consent and Deletion Records
Records of consent, withdrawal, deletion requests, and compliance actions may be retained separately from the image for as long as reasonably necessary to meet legal, security, audit, and dispute-resolution obligations.
Backups
Residual copies may remain temporarily in secure backups until they are overwritten or deleted through the normal backup lifecycle.
Backups should not be restored for ordinary commercial use after a valid deletion request.
Merchant-Specific Retention
Where the Merchant lawfully configures a different retention period, that period must be disclosed to the shopper before image submission.
The Merchant must not retain an image longer than necessary for the disclosed purpose.
Requesting Image Deletion
You may request deletion of your Virtual Try-On image or generated preview by contacting:
- The Merchant whose store provided the Virtual Try-On feature
- WardrobeIt at hi@wardrobeit.com
To help identify the relevant session, your request should include available information such as:
- Merchant or store name
- Store URL
- Approximate date and time of the try-on
- Product viewed
- Email address used, if any
- Session reference, if available
- Description of the deletion request
Do not send the original photograph again unless specifically requested through a secure method.
WardrobeIt or the Merchant may need to verify the request before deleting information.
WardrobeIt may route the request to the applicable Merchant where the Merchant is responsible for responding under applicable privacy law.
Information may be retained where legally required, necessary to protect legal rights, required to resolve security abuse, or permitted under another applicable legal exception.
Downloaded or Saved Images
Where a shopper downloads, screenshots, saves, or shares a generated preview, WardrobeIt may no longer control copies stored:
- On the shopper’s device
- In cloud photo storage
- In messaging applications
- On social media
- With another person
- Through third-party sharing services
You are responsible for any copy you choose to download or share.
Generated previews should not be presented as authentic photographs or used to mislead another person about actual product appearance.
Sharing with Service Providers
WardrobeIt may use carefully selected service providers to support:
- Image processing
- AI generation
- Cloud hosting
- Content delivery
- Security
- Abuse detection
- Error monitoring
- Support
- Data storage
- Infrastructure operations
These providers may process submitted images, generated previews, or related technical data only to perform services for WardrobeIt or the applicable Merchant.
WardrobeIt requires applicable providers to:
- Process information only under authorized instructions
- Protect information using appropriate safeguards
- Restrict employee and contractor access
- Avoid independent advertising use
- Avoid unauthorized disclosure
- Delete or return information according to the applicable agreement
- Notify WardrobeIt of relevant security incidents
WardrobeIt should maintain an up-to-date list of relevant subprocessors through its Privacy Policy, Data Processing Addendum, Security and Trust Center, or another appropriate disclosure.
Other Circumstances in Which Information May Be Disclosed
WardrobeIt may disclose information where reasonably necessary to:
- Comply with applicable law
- Respond to a valid legal request
- Enforce the Terms of Service
- Investigate fraud, abuse, or security incidents
- Protect the rights or safety of WardrobeIt, Merchants, shoppers, or others
- Complete a merger, financing, acquisition, restructuring, or sale of relevant business assets
Where business ownership changes, image information remains subject to this policy or an equivalent level of protection unless a different use is lawfully disclosed and authorized.
WardrobeIt and Merchant Responsibilities
When Virtual Try-On is provided through a Merchant storefront, the Merchant generally determines whether the feature is enabled, which products are eligible, where it appears, and how it is presented to shoppers.
Depending on applicable privacy law:
- The Merchant may act as the business or data controller.
- WardrobeIt may act as the service provider or data processor.
- WardrobeIt may act independently for limited security, fraud-prevention, legal-compliance, or service-administration purposes.
The exact relationship may be further described in a Data Processing Addendum or commercial agreement.
Merchant Responsibilities
The Merchant is responsible for:
- Enabling Virtual Try-On only for eligible products
- Displaying the approved consent notice
- Providing an accurate privacy policy
- Obtaining any required consent
- Avoiding hidden or automatic image capture
- Providing accurate product images and information
- Reviewing retention and deletion settings
- Responding to applicable privacy requests
- Avoiding use involving children
- Testing the experience before launch
- Providing a support route
- Following applicable privacy, consumer-protection, accessibility, and ecommerce laws
The Merchant must not use WardrobeIt Virtual Try-On for surveillance, identity verification, sensitive classification, discriminatory profiling, or another purpose not approved by WardrobeIt.
Security
WardrobeIt uses administrative, technical, and organizational safeguards intended to protect images and related information against unauthorized access, loss, misuse, alteration, or disclosure.
Safeguards may include, where appropriate:
- Access restrictions
- Role-based permissions
- Secure transmission
- Protected infrastructure
- Logging and monitoring
- Vendor controls
- Incident-response procedures
- Data minimization
- Retention and deletion processes
No system can guarantee complete security.
You should not use Virtual Try-On on a shared or public device if other people may access the submitted image or generated preview.
You should promptly report suspected unauthorized access or disclosure to hi@wardrobeit.com.
International Processing
WardrobeIt and its service providers may process information in countries other than the country where the shopper or Merchant is located.
Where required, WardrobeIt uses appropriate safeguards for international transfers, which may include contractual protections, transfer assessments, or other legally recognized mechanisms.
Additional information may be provided through the WardrobeIt Privacy Policy or an applicable Data Processing Addendum.
Your Privacy Rights
Depending on where you live, you may have rights concerning personal information processed through Virtual Try-On.
These rights may include the right to:
- Request access
- Request deletion
- Request correction
- Request information about processing
- Withdraw consent
- Restrict certain processing
- Object to certain processing
- Receive a portable copy where applicable
- Appeal the handling of a privacy request
- Limit certain uses of sensitive personal information
- Submit a complaint to an applicable privacy authority
These rights are not absolute and may be subject to legal exceptions.
Where the Merchant controls the shopper relationship, WardrobeIt may direct the request to the Merchant and assist the Merchant with its response.

WardrobeIt may request information needed to verify the request and locate the relevant Virtual Try-On session.
WardrobeIt will not discriminate against a shopper for exercising an applicable privacy right.
Automated Processing
WardrobeIt uses automated systems to generate Virtual Try-On previews.
The feature is not intended to make decisions that produce legal or similarly significant effects concerning the shopper.
The generated preview should not be used to determine eligibility for:
- Employment
- Credit
- Insurance
- Housing
- Healthcare
- Education
- Government services
- Legal rights
- Another high-impact opportunity
The preview supports product visualization only.
Accuracy and Product Limitations
Virtual Try-On is an approximate visualisation.
The generated preview may differ from the real product due to:
- Image quality
- Lighting
- Camera angle
- Pose
- Product image quality
- Product mapping
- Colour display
- Screen settings
- Automated generation limitations
- Product shape
- Fabric movement
- Product sizing
- Product availability
The Merchant’s product page and ecommerce system remain the source of truth for:
- Product identity
- Product images
- Product description
- Available colours
- Available sizes
- Price
- Availability
- Variant validity
- Store policies
- Checkout
WardrobeIt does not guarantee that a product will fit, suit the shopper, remain available, arrive by a particular date, or appear in real life as shown in the generated preview.
Prohibited Images and Uses
You must not submit an image that:
- Shows a child or minor
- Contains nudity or sexually explicit content
- Contains intimate imagery
- Was captured without permission
- Depicts violence or illegal activity
- Contains another person’s confidential information
- Contains government identification
- Contains payment-card information
- Contains medical records
- Contains passwords or access credentials
- Violates copyright, privacy, or publicity rights
- Is intended for harassment, exploitation, impersonation, or fraud
- Is intended to create deceptive or misleading content
- Violates applicable law
WardrobeIt may block, delete, or report content where required to protect users, comply with law, or enforce applicable policies.
Account and Store Analytics
Merchants may receive aggregated or session-level information about Virtual Try-On usage, such as:
- Number of try-on starts
- Number of completed previews
- Product or colour selected
- Product actions following a preview
- Add-to-Cart activity
- Feature errors
- Eligible product coverage
A Merchant should not receive the shopper’s submitted image or generated preview unless image access has been explicitly implemented, legally reviewed, disclosed, and authorized.
Try-on-to-cart activity indicates that events occurred within a related journey. It does not prove that Virtual Try-On caused the cart action or sale.
Changes to This Policy
WardrobeIt may update this policy to reflect changes in:
- Virtual Try-On functionality
- Image-processing technology
- Service providers
- Retention practices
- Privacy requirements
- Security controls
- Merchant configuration
- Applicable law
The updated policy will display a revised Last Updated date.
Where required, WardrobeIt or the Merchant will provide additional notice or request renewed consent before materially changing how previously collected images are used.
Relationship with Other WardrobeIt Policies
This policy should be read together with:
- WardrobeIt Privacy Policy
- WardrobeIt Terms of Service
- WardrobeIt Security and Trust Center
- The applicable Merchant privacy policy
- Any applicable consent notice
- Any applicable Data Processing Addendum
If a Merchant promises stronger protections than this policy, the Merchant remains responsible for honouring those commitments.
If another WardrobeIt agreement provides stronger image-privacy protection, the stronger protection will apply to the extent of the conflict.
